Monitoring Service Agreements

Mandatory Payment Lapse & Suspension Clause

This clause applies to ALL monitoring service tiers, regardless of contract status.

Immediate Suspension of Service: Any lapse in billing, failure to process scheduled recurring payments, or failure to pay outstanding balances within the designated grace period will trigger an immediate and automatic suspension of all monitoring services and access to linked smart systems.

Suspension will remain in effect until all outstanding balances are paid in full and the customer's account is brought current. During the suspension period, the system will not transmit alarms to the central station, and life-safety or intrusion events will not receive professional response.

Month-to-Month (No Contract) Monitoring Service Agreement

By selecting a Month-to-Month Monitoring Plan, the Customer agrees to the following terms:

  1. Service Provision: KLEVR by DEFENDER SECURITY ("Company") agrees to provide professional alarm monitoring services on a month-to-month basis.
  2. Billing: The Customer agrees to an automatic recurring monthly charge to their saved payment method. Services are billed in advance for the upcoming month.
  3. Cancellation: The Customer may cancel services at any time prior to the next billing cycle. No refunds will be provided for partial months.
  4. Equipment Ownership: The Customer owns the equipment outright (if paid in full or via Afterpay).
  5. Suspension: As detailed above, failure to pay the monthly monitoring fee will result in immediate suspension of services.
  6. Liability: The Company's liability is limited to the amount paid for the monitoring services in the preceding 12 months. The Company is not an insurer.

36-Month Contract Monitoring Service Agreement

By selecting a 36-Month Contract Plan, the Customer agrees to the following terms:

  1. Term: The Customer agrees to a binding thirty-six (36) month term for professional alarm monitoring services in exchange for a lower monthly rate.
  2. Equipment Ownership: The equipment is paid in full at the time of purchase and is fully owned by the Customer.
  3. Billing: The Customer agrees to an automatic recurring monthly charge to their saved payment method for the duration of the term.
  4. Early Termination: If the Customer cancels prior to the end of the 36-month term, the Customer is subject to an early termination fee of $250.
  5. Suspension: As detailed above, failure to pay the monthly monitoring fee will result in immediate suspension of services. The contract term remains in effect during suspension, and monthly charges continue to accrue.
  6. Liability: The Company's liability is limited to the amount paid for the monitoring services in the preceding 12 months. The Company is not an insurer.

12-Month Apartment Contract Monitoring Service Agreement

By selecting an Apartment Partner Monitoring Plan, the Customer agrees to the following terms:

  1. Term: The Customer agrees to a binding twelve (12) month term for professional alarm monitoring services at the apartment partner rate.
  2. Eligible Offer: This pricing is available only for approved apartment-complex partner codes activated by KLEVR by DEFENDER SECURITY.
  3. Equipment & Installation: The apartment renter kit and the Customer's selected installation option, whether $99 Pre-Programmed Peel & Stick DIY or $149 Professional Installation, are paid at the time of signup unless the Customer elects to prepay the full 12 months of monitoring during checkout.
  4. Billing: The Customer agrees to automatic recurring monthly charges to their saved payment method for the duration of the term unless the full 12-month monitoring amount is prepaid at signup.
  5. Early Termination: If the Customer cancels prior to the end of the 12-month term, the Customer is subject to an early termination fee of $250.
  6. Suspension: As detailed above, failure to pay the monthly monitoring fee will result in immediate suspension of services. The contract term remains in effect during suspension, and monthly charges continue to accrue until the account is resolved.
  7. Liability: The Company's liability is limited to the amount paid for the monitoring services in the preceding 12 months. The Company is not an insurer.
